TERMS & CONDITIONS OF SALE AND WEBSITE USE

These Terms apply when you use the Fenton Farm Eggs website or place a consumer order through our online store.

Please read them before ordering.

The online store is operated by Fenton Farm Limited trading as Fenton Farm Eggs.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded, including your statutory rights in relation to goods that are faulty, unsafe, not as described or otherwise do not meet legal requirements.

2. OUR ONLINE STORE

Our online store is powered by Shopify, which provides the ecommerce technology used to present products, manage checkout and process the online shopping experience.

Any contract for goods purchased from this store is between you and Fenton Farm Limited trading as Fenton Farm Eggs, not Shopify.


3. CONSUMER SALES

The online checkout is currently intended for consumer purchases only.

We do not currently accept wholesale or business-to-business orders through this website checkout. Separate arrangements may apply to any trade sales agreed directly with us.


4. PRODUCTS AVAILABLE ONLINE

Our online shop currently sells jars of Fenton Farm Eggs mayonnaise.

Egg-related pages on the website are currently provided for information only. Eggs are not currently available to purchase through the online checkout.

We take reasonable care to describe products accurately. Food packaging, recipes, ingredients and presentation may change from time to time.

Before ordering a food product, please read the current product information shown on the website.


5. INGREDIENTS, ALLERGENS AND FOOD INFORMATION

Important food information, including ingredients and allergens, should be checked before purchase and again on the label of the product delivered to you.

If you or anyone you are buying for has a food allergy or intolerance, please carefully check the current ingredients and allergen information before ordering.

The product label supplied with the food contains the current packaging information, including storage instructions and the best-before date.

The current mayonnaise labels state that once opened the product must be kept refrigerated and consumed within 4 weeks.


6. MINIMUM MAYONNAISE ORDER

The minimum online mayonnaise order is 6 jars.

Customers may mix mayonnaise flavours in the same order to reach the 6-jar minimum.

The website will not allow checkout for a mayonnaise order that does not meet the applicable minimum quantity.


7. PRICES AND VAT

Prices shown to consumers on the website are the prices payable for the products at the time the order is placed, subject to any obvious pricing error.

Fenton Farm Limited is VAT registered under VAT number GB844244040.

Standard delivery to eligible UK mainland addresses is included in the product price.

There is no separate standard UK mainland delivery charge and no minimum order value required to qualify for free delivery.

If a non-standard delivery arrangement requires an additional charge, this will be made clear before you complete your order.


8. PAYMENT

Payment is taken through Shopify checkout.

Available payment methods may include Shopify Payments and Apple Pay, depending on the options shown to you at checkout.

You must be authorised to use the payment method selected.


9. PLACING AN ORDER

Before completing checkout, you are responsible for reviewing:

- the products and quantities in your basket;
- the delivery address;
- your contact details;
- the delivery option and charge; and
- the total amount payable.

When you submit an order, you are making an offer to purchase the goods shown in your order.


10. ORDER ACCEPTANCE

After checkout, we will normally send an order acknowledgement confirming that we have received your order.

The acknowledgement does not itself mean that we have accepted the order.

Unless we tell you otherwise, our contract with you is formed when we send confirmation that the order has been dispatched.

If we cannot accept an order, we will tell you and refund any payment taken for the affected goods.

Reasons we may be unable to accept an order include:

- a product being unavailable;
- an obvious error in price or product information;
- payment or fraud-prevention checks failing;
- the delivery address being outside our delivery area; or
- circumstances that prevent us from lawfully supplying the product.


11. AVAILABILITY AND SUBSTITUTIONS

All products are subject to availability.

We do not make product or flavour substitutions without the customer's agreement.

If a product becomes unavailable after you order, we will contact you where appropriate or refund the affected item or order.


12. DELIVERY

Our Shipping & Delivery Policy forms part of these Terms.

We currently deliver eligible online orders to UK mainland addresses only using DPD.

Our normal dispatch days are Monday and Thursday, and orders are normally prepared for dispatch within 1–2 working days.

Our usual DPD service is next-working-day delivery after collection.

Some Scottish Highlands and other remote mainland postcodes may have different DPD delivery times or service availability.

For consumer orders where we arrange delivery, the goods remain at our risk until they are delivered to you or to a person or place you have nominated in accordance with the delivery arrangements.

Delivery times are estimates unless we expressly agree otherwise.

Unless another delivery period has been agreed, your statutory rights concerning delivery within the legally required period continue to apply.


13. SAFE PLACE AND DELIVERY INSTRUCTIONS

Where DPD makes the option available, you may nominate a safe place or neighbour.

Please make sure any nominated location is appropriate for a food parcel.

If you provide an incorrect or incomplete address, or a parcel is returned to us following repeated unsuccessful delivery for a reason attributable to you, we may charge the reasonable additional cost of re-delivery before sending the order again.

This does not affect your rights where the delivery problem is our responsibility or the carrier's responsibility.


14. CANCELLATIONS, RETURNS AND REFUNDS

Our Returns, Cancellations & Refunds Policy forms part of these Terms.

We do not offer an additional goodwill change-of-mind return period beyond statutory rights.

Some food products may be exempt from the normal online cooling-off right where they are liable to deteriorate or expire rapidly.

Where sealed goods are not suitable for return for health protection or hygiene reasons, a statutory cancellation right may also be lost once the seal has been broken after delivery.

These rules do not remove your rights where goods are faulty, damaged, unsafe or not as described.


15. DAMAGED, FAULTY OR INCORRECT GOODS

Please inspect your order promptly after delivery.

If a jar is broken, leaking, has a compromised seal, is incorrect, or the goods are otherwise faulty or not as described, contact us as soon as possible:

We may ask for photographs of the product, packaging, best-before date or batch information.

Do not consume a product that appears unsafe, contaminated, leaking or has a compromised seal.

Where appropriate, we will normally resolve shipping damage with a replacement or refund, depending on the circumstances and your statutory rights.


16. PROMOTIONS AND DISCOUNT CODES

We may introduce discount codes, gift cards or other promotions in the future.

Any additional terms applying to a particular offer will be displayed with that offer.

Promotional terms do not remove statutory consumer rights.


17. CUSTOMER ACCOUNTS

Where Shopify or Shop customer account functions are available, you are responsible for keeping your account access details secure and for providing accurate information.

Please contact us if you believe your account is being used without permission.


18. WEBSITE USE

You may use the website for lawful purposes.

You must not knowingly:

- interfere with the operation or security of the website;
- attempt unauthorised access to the website or another person's account;
- introduce malicious code;
- use the website for fraud or unlawful activity;
- impersonate another person; or
- copy, scrape or commercially exploit protected website content in a way that infringes our rights or applicable law.


19. INTELLECTUAL PROPERTY

Unless otherwise stated, the Fenton Farm Eggs name, branding, photographs, text, graphics, website design and other content are owned by or licensed to Fenton Farm Limited.

You may view and use the website for normal shopping and personal reference.

You may not reproduce or commercially exploit our protected content without permission except where the law allows.


20. THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party services, including Shopify, payment providers, DPD and other websites.

Third parties may have their own terms and privacy notices.

We are not responsible for unrelated third-party websites that we do not control.


21. PRIVACY

Our Privacy Notice explains how we collect and use personal information in connection with the website and online store.

Please read the Privacy Notice alongside these Terms.


22. OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- statutory consumer rights that cannot lawfully be excluded or restricted.

Because this website checkout is intended for consumers, we are not responsible for business losses such as loss of profit, revenue or business opportunity suffered by a person using a consumer order for business purposes, to the extent permitted by law.


23. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control where the law permits this.

We will take reasonable steps to minimise the effect of such events.

This section does not remove any statutory right you have in relation to delayed, failed or cancelled delivery.


24. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version applying to an order is normally the version in force when that order is placed.

Changes will not retrospectively remove rights that have already arisen under an existing contract.


25. GOVERNING LAW

These Terms and consumer contracts made through the online store are governed by the law of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, any mandatory consumer protections or rights concerning where proceedings may be brought continue to apply.


26. COMPLAINTS

If you have a complaint, please contact us and we will try to resolve it fairly and promptly.

We do not currently subscribe to a specific Alternative Dispute Resolution scheme.
